Order of the Ministry of Health and Social Development of the Russian Federation of December 29, 2007 No.818 Incentive payments include:

  • for the intensity and high results of work;
  • for the quality of work performed;
  • for continuous work experience, length of service;
  • performance bonuses.
Incentive payments are made by decision of the head of the institution within the budget allocations for the remuneration of employees, as well as funds received from income-generating activities directed by the institution to remunerate employees.

The specific amount of the bonus can be determined both as a percentage of the employee's salary, and in absolute terms.

According to Part 2 Art. 135 of the Labor Code of the Russian Federation incentive payments are established by collective agreements, agreements, local regulations in accordance with labor legislation and other acts containing norms labor law. At the same time, a local regulatory act providing for incentive payments should be adopted taking into account the opinion of the representative body of employees ( Part 4 Art. 135). Gifts for employees

To ensure that the costs of acquiring gifts for staff associated not with holidays, but with production results, high achievements in labor, and other similar payments are taken into account in income tax expenses, in employment contracts with employees there should be a condition that they are covered by the incentive system in force in the organization. This explanation is given by the Ministry of Finance in Letter No. 22.04.201003‑03‑06/2/79 .

With regard to gifts for holidays, the Ministry of Finance has repeatedly explained that such expenses cannot be taken into account when calculating income tax, since they are not related to the production results of employees (see, for example, Letter No. 21.02.201103‑03‑06‑01/59 ).
