In accordance with Art. 23.2 of the Law of the Russian Federation of February 21, 1992 N 2395-1 "On Subsoil", the Law of the Orenburg Region of 05/07/2013 N 1441 / 424-V-OZ "On subsoil plots of local importance", Regulations on the Ministry of Natural Resources, Ecology and Property relations of the Orenburg region, approved by decree of the Governor of the Orenburg region of March 14, 2011 N 120-uk:

1. Form a commission for the approval of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance, consisting of in accordance with Appendix No. 1.

2. Approve the regulation on the commission for the approval of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance, in accordance with Appendix No. 2.

1. General Provisions

1.1. The Commission for the coordination of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance (hereinafter referred to as the Commission) was formed in order to ensure the implementation of the powers of the Ministry of Natural Resources, Ecology and Property Relations of the Orenburg Region (hereinafter referred to as Ministry) for making decisions on the approval of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance. The recommendations of the Commission are the basis for the Ministry to make decisions on approval or refusal to approve technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance.

1.2. The activities of the Commission are carried out on the basis of the Constitution of the Russian Federation, the Law of the Russian Federation dated 21.02.1992 N 2395-1 "On Subsoil", the Law of the Orenburg Region dated 07.05.2013 N 1441 / 424-V-OZ "On subsoil plots of local importance", Government decrees of the Russian Federation dated 03.03.2010 N 118 "On approval of the Regulations on the preparation, approval and approval of technical projects for the development of mineral deposits and other project documentation for the performance of work related to the use of subsoil plots, by types of minerals and types of subsoil use", Government decrees RF dated December 29, 2001 N 921 "On Approval of the Rules for Approving the Standards for Losses of Minerals in Mining, Technologically Related to the Accepted Scheme and Technology of Deposit Development", other regulatory legal acts, as well as on the basis of this Regulation.

1.3. The composition of the Commission is approved by the order of the Ministry.

1.4. The commission works in personal composition.

Representatives of state authorities, local self-government bodies, as well as independent specialists and experts may be involved in the meetings of the Commission upon agreement.

A representative, specialist or expert invited to the meeting, who is not a member of the Commission, has the rights and obligations of the members of the Commission, provided for in subparagraphs 1, 3 - 5 of paragraph 2.1 of these Regulations, and also has the right of an advisory vote when making decisions of the Commission.

1.5. The Ministry has the right to change the number of members of the Commission and / or replace the member (s) of the Commission by issuing an appropriate order in the following cases:

1) changes in the personnel of the ministry or changes in the circle official duties officials ministries included in the Commission;

2) on the initiative of the federal authorities, the candidacies of representatives of which are included in the composition of the Commission for approval, in accordance with the written applications received from them on the withdrawal of candidacies and their replacement.

1.6. If a member of the Commission is unable to attend the meeting, he shall notify the chairman of the Commission in writing in advance.

The notice of impossibility to participate in the meeting of the Commission may be accompanied by a written opinion of a member of the Commission on the agenda of the meeting of the Commission.

1.7. The meeting of the Commission shall be considered competent if at least fifty percent of the total number of its members is present.

1.8. The Deputy Minister of Natural Resources, Ecology and Property Relations of the Orenburg Region, who is in charge of subsoil use issues, is the Chairman of the Commission ex officio.

In the absence of the chairman of the Commission, his duties are performed by any member of the Commission on behalf of the chairman.

1.9. The Commission performs the following functions:

1) considers technical projects for the development of mineral deposits and other project documentation for the performance of work related to the use of subsoil plots of local importance;

2) considers, among other things, as part of the project documentation, the standards for the loss of common minerals during their extraction;

3) if necessary, involve representatives of public authorities, local governments, specialists, independent experts, create working groups of specialists from relevant industries to make decisions on issues under consideration;

4) based on the results of consideration of the materials submitted by interested parties, prepare recommendations for the Ministry on approval or refusal to approve (with justification of the reasons for refusal) materials of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance.

1.10. Organizational and technical support of the activities of the Commission is carried out structural subdivision Ministry exercising powers in the field of licensing and subsoil use.

2. Obligations and rights of the Commission, its individual members

2.1. Duties and rights of members of the Commission:

1) know and be guided in their activities by the legislation of the Russian Federation and these Regulations;

2) personally attend the meetings of the Commission;

3) not to disseminate information constituting a state, official or commercial secret that became known in the course of participation in the work of the Commission;

4) get acquainted with all the documents and information submitted for consideration;

5) speak on the agenda items at the Commission meetings, give oral and written opinions on the agenda items of the Commission meetings;

7) check the correctness of the content of the Protocol of the meeting of the Commission;

8) sign the Protocol of the meeting of the Commission;

9) in case of disagreement with the position adopted by the majority of the members of the Commission and reflected in the Minutes of the meeting of the Commission, the member of the commission shall attach a written opinion to the minutes.

2.2. Chairman of the Commission:

1) announce the composition of the Commission;

2) carry out general management of the work of the Commission;

3) declare the meeting competent or make a decision to postpone it due to the lack of a quorum;

4) opens and conducts meetings of the Commission, announces breaks;

5) determine the procedure for consideration of the issues under discussion;

6) if necessary, submits for discussion by the Commission the issue of involving representatives of state authorities, local governments, independent specialists, experts in the work of the Commission;

7) carry out other actions related to the work of the Commission, in accordance with the legislation of the Russian Federation and these Regulations.

2.3. Secretary of the Commission:

1) prepares the meetings of the Commission, including registration and distribution required documents informing the members of the Commission on all issues related to their functions, including notifying the persons participating in the work of the Commission of the time and place of the meetings at least three working days before they begin and providing the members of the Commission with the necessary materials;

2) keep minutes of the meeting of the Commission;

3) carry out other actions of an organizational and technical nature related to the work of the Commission, in accordance with the legislation of the Russian Federation and these Regulations.

3. Procedure for making decisions by the Commission

3.1. Based on the results of consideration of the materials submitted by interested parties, the Commission decides:

Recommend to the Ministry to agree on technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance, or

Recommend to the Ministry to refuse approval of technical projects for the development of deposits of common minerals and other project documentation for the performance of work related to the use of subsoil plots of local importance, with justification of the reasons for the refusal.

3.2. Decisions of the Commission on the issues under consideration are taken by open voting. Each member of the Commission has one vote.

3.3. The decision is considered adopted if more than half of the members of the Commission present at the meeting voted for it.

3.4. The decision of the Commission is documented in a protocol signed by all present members of the Commission.

Written opinions of members of the Commission or representatives of public authorities, local authorities, independent specialists and experts invited to participate in the meeting of the Commission shall be attached to the minutes.

4. Responsibility

4.1. Members of the Commission bear personal responsibility for the decisions taken in the course of the work of the Commission in accordance with the legislation of the Russian Federation.

I. General provisions

1. The Interdepartmental Commission for Coordinating the Border of the Moscow Region with Adjacent Subjects of the Russian Federation (hereinafter referred to as the Commission) is a collegial coordinating body formed to ensure interaction between the central executive bodies of state power of the Moscow Region, territorial bodies of federal executive bodies in the Moscow Region for the preparation of agreed decisions in order to implement measures to establish the border of the Moscow region.

2. The Commission in its activities is guided by the Constitution of the Russian Federation, the laws of the Russian Federation, other regulatory legal acts of the Russian Federation, the Charter of the Moscow Region, the laws of the Moscow Region and other regulatory legal acts of the Moscow Region, as well as these Regulations.

II. Tasks of the Commission

3. The main tasks of the Commission are:

1) ensuring the interaction of the central executive bodies of state power in the Moscow Region, territorial bodies of federal executive bodies in the Moscow Region in order to prepare agreed decisions for the implementation of measures to establish or change the border of the Moscow Region;

2) preparation of proposals on the issue of establishing or changing the border of the Moscow Region with neighboring subjects of the Russian Federation in accordance with the legislation of the Russian Federation and the legislation of the Moscow Region.

III. Composition of the Commission

4. The Commission consists of the Chairman of the Commission, Deputy Chairman of the Commission, Secretary of the Commission, members of the Commission.

5. The Chairman of the Commission is the Deputy Chairman of the Government of the Moscow Region - Head of the Main Department of Territorial Policy of the Moscow Region.

6. If necessary, expert organizations may be involved in the work of the Commission, specialized organizations and (or) experts (specialists).

7. The work of the Commission is managed by the Chairman of the Commission. In the absence of the Chairman of the Commission, his duties are performed by the Deputy Chairman of the Commission.

8. Chairman of the Commission:

1) manage the activities of the Commission;

2) approve the agenda of the meeting of the Commission;

3) determines the place, date and time of the meetings of the Commission;

4) chair the meetings of the Commission;

5) distribute duties among the members of the Commission;

6) organize control over the implementation of decisions adopted by the Commission;

7) signs the minutes of the meetings of the Commission;

9. Deputy Chairman of the Commission:

1) participate in the meetings of the Commission;

2) makes proposals on issues within the competence of the Commission;

3) coordinate the agenda of the meetings of the Commission;

4) chairs the meetings of the Commission in the absence of the Chairman of the Commission.

10. Secretary of the Commission:

1) notify the members of the Commission about the agenda, place, date, time of the next meeting of the Commission and invite to its meeting;

2) prepares and sends to the Chairman of the Commission, Deputy Chairman of the Commission, members of the Commission and other persons, at the direction of the Chairman of the Commission, the documents necessary for the work of the Commission;

3) draw up the minutes of the meetings of the Commission;

4) organize the preparation of the meetings of the Commission;

5) has the right to receive from the Chairman of the Commission, Deputy Chairman of the Commission, members of the Commission, central executive bodies of state power of the Moscow Region, government agencies Moscow region, local authorities municipalities Moscow region, public and other organizations documents necessary for the work of the Commission;

11. Members of the Commission:

1) participate in the meetings of the Commission;

2) carry out the decisions of the Commission and instructions of the Chairman of the Commission;

3) report at the meetings of the Commission on issues within their competence;

4) make proposals on issues within the competence of the Commission;

5) get acquainted with the materials on the issues considered by the Commission;

6) submit documents to the meetings of the Commission, make proposals for amendments and additions to the draft documents of the Commission.

V. Rights of the Commission

12. The Commission, within its competence, has the right to:

1) to request from the territorial bodies of the federal executive bodies for the Moscow Region, the central executive bodies of state power of the Moscow Region, within the powers granted to them, publicly available information and reference materials related to the coordination of the border of the Moscow Region with neighboring subjects of the Russian Federation;

2) hear at the meetings information from the territorial bodies of the federal executive bodies for the Moscow Region, the central executive bodies of state power of the Moscow Region, organizations on issues within the competence of the Commission;

3) form working groups to prepare draft decisions and other materials submitted for consideration by the Commission.

VI. Order of the Commission

13. The form of work of the Commission is its meeting.

14. Representatives of other central executive bodies of state power of the Moscow Region, local self-government bodies of municipalities of the Moscow Region may be invited to meetings of the Commissions by decision of the Chairman of the Commission.

15. The Commission considers the submitted materials on issues related to the activities of the Commission.

16. Meetings of the Commission are held in accordance with the agenda approved by the Chairman of the Commission, but at least once a year.

The members of the Commission must be informed about the date, time, venue and agenda of the next meeting of the Commission no later than three days before the expected date of its holding.

17. The meeting of the Commission is chaired by its chairman, and in case of his absence - by the deputy chairman of the Commission.

18. The meeting of the Commission is competent if it is attended by at least half of the total number of members of the Commission.

19. The Commission takes a decision on the issue under consideration by open voting by a simple majority of votes. In case of equality of votes, the vote of the Chairman of the Commission is decisive.

20. The decision of the Commission is drawn up in a protocol, which is signed by the chairman of the Commission.

Documents on behalf of the Commission are signed by the Chairman of the Commission, in his absence - by the Deputy Chairman of the Commission.

21. Organizational and technical support for the activities of the Commission is carried out by the Main Directorate of Territorial Policy of the Moscow Region.
