Russian legislation forces enterprises to determine annual vacation schedules. For the same reason, the government did not begin to establish for which an employee who wants to leave for must apply. Often this schedule is an ordinary formality. Therefore, it is advisable to inform the employee about the desire to go on vacation as early as possible, otherwise his absence may interfere with the work processes of the company.

How much is an application for a vacation written for and how to make sure that you go on vacation exactly when you need it?

The right to receive the first annual leave appears after 6 months of continuous work in the company. In order to go to it, the employee must correctly compose and contact the company management with it.

Various types of vacations are provided: study, maternity, annual and additional. Some of them are paid, while others remain unpaid. Russian law allows these rules to be set at the discretion of the authorities. Russian legislation highlights a number of the following conditions:

  1. the employee does not have to write an application if the leave is given on the basis of the schedule,
  2. the boss is obliged to remind the employee about the start of the vacation 14 days in advance,
  3. Russian does not determine the period in which the employee is obliged to apply for leave of his own free will.

If the company does not make a schedule, without a written application, management will not be able to grant leave entitlements. In order for an employee to be able to issue it, certain grounds are needed for this. If the procedure takes place in an oral format, the company may declare that it went away without permission and simply skipped. To prevent this from happening, and to be provided at the right time, the only and main reason for obtaining leave is a written employee.

Coordination of terms with the employer

In practice, it is impossible to predict exactly when it will be necessary to take. That is why it is necessary to agree on the beginning of the vacation only with the management of the company. After submitting the application, the employee must wait for a response. As a rule, holidays are given without any problems, but dates are agreed in any case. The head compares the vacation schedules of the working personnel and stipulates his decision. Usually, it takes from 1 to 7 days.

Even if the date in the application coincides with, the manager can personally shift these dates. Usually, this happens in unforeseen situations, due to which the employee cannot be present at the workplace. Today there are organizations that accept documents by e-mail. If the company's communications in this area are poorly developed, or are at the development stage, it is better not to take risks and personally come to the personnel department.

Based on Part 9 of Art. 136 of the Labor Code, it is clear that the company is obliged to pay vacation pay no later than 3 days before the vacation itself. Therefore, the order to grant leave must be signed no later than 3 days, since this time is enough for the manager to sign the application and calculate the required amount of money.

Deadlines for applying for leave

The vacation schedule is drawn up at the very beginning of the year and all the working staff will certainly be notified about it. The employee goes on vacation from the first day specified in the schedule.

Based on Article 123, the manager is obliged to inform the employee 14 days before the start of the vacation.

If the company does not have a vacation schedule, the employee must apply in person with the application. There are times when the authorities require a document 2 weeks before the expected vacation date, the latter are ready to provide vacation the very next day after the application is submitted. The following companies accept applications at least 4 days in advance, since it takes 3 days to calculate holiday pay.

When do you need to apply for leave?

In large companies, with a large set, this period can increase up to 3-4 weeks, since it takes a lot of time to process documents. The only exception is pregnant women. The legislation allows them to apply 1 day before the expected vacation date.

Despite the fact that the legislation does not specify specific applications, lawyers still recommend contacting the management 2 weeks before the date indicated in the document. So, the chances of getting a vacation at the scheduled time increase. That is why the employee decides for himself when to apply with an application, in 2 months or in just 2 weeks. The main thing is that this time should be enough for registration in the accounting department of the organization.
