How to write a vacation application

The right to leave is guaranteed by labor legislation. However, in order to exercise this right, the employee must first submit an application to the management of the enterprise where he works. Let's figure out exactly how such a document is drawn up, what forms and forms can be used in this case.

Before applying, you need to consider what kind of vacation you can use. Legislation provides workers with the right to the following types of it:

  1. Another, at least 4 calendar weeks. You can get it after six months of continuous work in the organization. In the future, this type of vacation is granted annually. A strict application form for annual paid leave is not approved by law.
  2. Additional. It is set for certain categories of workers employed in special conditions (in the Far North, with an irregular day, in hazardous production, etc.).
    By pregnancy. It is received by women who present a sick leave certificate confirming at least 30 weeks of pregnancy. Leave is granted before and after childbirth in order to restore the health of the mother.
  3. Newborn care. Usually mothers take it, but by law, any other family member is entitled to receive it.
  4. Training. It is received by employees who combine work with training.
    Unpaid. It is granted to employees who have experienced difficult personal circumstances: the death or serious illness of relatives, etc. Such leave is granted in agreement with the management, but in some cases it cannot be refused (for example, pensioners, veterans, newlyweds, etc.).

How to write a leave application

The law does not set strict rules on how to write a leave application. As for the sample form, in practice certain requirements for the design of this document have been established. Moreover, there are, although unofficial, but convenient ready-made forms that can be filled out when applying. You can find such forms either at the enterprise itself, or on legal, personnel or accounting resources on the Internet.

It is accepted that the application should consist of the following main parts:

  1. "A cap". It contains the main details of the document.
  2. The main part containing a request to provide leave and an indication of the time from which the employee wishes to receive it.
  3. Signature and date of compilation. The date can also be put in the header.

In turn, the first part traditionally contains the following content items:

  1. Name (either full or surname and initials) and position of the person to whom the application is submitted. According to the law, the decision to send an employee on vacation is made by the head acting on behalf of the organization.
  2. The name and position of the employee seeking leave.
    If necessary, an indication of the structural unit of the enterprise (department, branch, etc.).
  3. It is also allowed to indicate the place where the application was made, although this design option is usually not practiced.

An application form can be obtained from the Human Resources Department.

This is the simplest application. It is required if the company does not have a vacation schedule approved by management. If the employee, for one reason or another, wants to receive it outside the schedule, he should indicate the reason.

Note: for the employee given above as an example, the main text of the application in this case may look like this: “I ask you to give me another vacation on October 1, 2016 for a period of 28 days outside the schedule due to the pregnancy and childbirth of my wife Akhmedova G. Yu. I am enclosing a copy of her disability certificate”

The employee has the right not to take vacation in whole, but in parts. The fact is that, according to the law, at least one of these parts must be equal to 14 days according to the calendar. Therefore, if an employee wishes to take advantage of a partial rest, he must submit an application to the head of the enterprise with the appropriate following content. Let's take a look at a specific example of how to write an application for a vacation for 14 days.

In addition to the annual leave, the employee may be released for a while from the performance of labor duties in several other cases. A sample vacation application template in this case is drawn up according to the same rules. Features will concern only the main part of the text, in which the citizen motivates the need to release him from work for a while. Since the heading of the document, as well as the date and signature in all situations will be exactly the same as when asking for annual rest, we will not repeat it in the samples.

Note: if an employee asks for a temporary release from performance of labor duties related to training, then the main part of the application will be worded something like this: “I ask you to grant me leave due to passing the session at Ensk State University from December 1 to December 15, 2016. I am enclosing a certificate-call from the ESU"

It should be noted that this kind of exemption is granted subject to the following conditions:

  • training must take place in an organization with state accreditation. Otherwise, exemption from work is granted only with the consent of the employer;
  • study leave is granted for various periods and under various conditions. So, for students in absentia in the third year to pass the session, it is up to 50 days with the preservation of the average salary. For full-time students, payment is not saved, and the term is only 15 days. However, such employees have the right to demand a reduction in working hours with the retention of half of the payment before the final certification;
  • benefits apply only to the acquisition of the first education. If an employee simultaneously studies at two universities, then he receives an exemption only upon a certificate-call from one of them. Which one, he has the right to choose on his own.

Note: for women going on maternity leave, approximately the following template of the main part is used: “I ask you to grant me maternity and pregnancy leave for 140 (one hundred and forty) days from March 1, 2016 and assign the due allowance for this time. The certificate of incapacity for work is attached.

Some rules regarding the submission of applications

The time separating the filing of an application from the granting of leave is not regulated by law. However, according to the Labor Code of the Russian Federation, the management of the enterprise is obliged to notify the employee in writing about the upcoming vacation no later than 2 weeks in advance. Based on this rule, we can conclude that the time interval between the application and the actual vacation should not be less than this period.

Although the vacation schedule is mandatory for both parties to the employment relationship, in some cases it may be violated.

This applies to situations in which the employee has the right to choose the time when to go on vacation:

  • during pregnancy and expected childbirth of the wife;
  • if the employee is a minor;
  • if he has some of the awards (the badge "Honorary Donor", the title of Hero, etc.) or a special status (veteran, victim of radiation, etc.).

The application itself can be written both by hand and using office equipment (typewriters, computers, etc.) - there is no difference from the point of view of the law. The only condition is a handwritten signature on the submitted document. Without it, the manager has every reason not to consider the document coming from a specific employee and not to take it into account.

The submitted application is registered according to the rules of office work established by the internal regulations of the organization and endorsed by the addressee. In the event that the leave is granted, an appropriate order is issued for the enterprise, with which the employee gets acquainted against signature.
